("we", "our", or "us"), including our website, fitness training programmes, and facilities, you agree to be bound by these Terms of Service. User Obligations

When using our services, you agree to:

• Provide accurate and complete information during registration and booking processes
• Follow all safety guidelines and instructions provided by our staff
• Respect other members, staff, and the facility
• Use equipment properly and report any damage or safety concerns immediately
• Disclose any medical conditions or health concerns that may affect your participation
• Arrive punctually for scheduled appointments and classes
• Pay all fees and charges in accordance with our payment terms
• Comply with facility rules and regulations
• Not engage in any behaviour that could endanger yourself or others

Health and Safety

You acknowledge that physical exercise involves inherent risks and that you participate in our programmes at your own risk. You are responsible for consulting with healthcare professionals before beginning any exercise programme, especially if you have pre-existing medical conditions. BrightLibrarium staff are not medical professionals, and our services do not constitute medical advice or treatment.

Booking and Cancellation Policy

Our booking and cancellation policies include:

• Bookings must be made in advance through our designated booking system
• Cancellations must be made at least 24 hours in advance to avoid charges
• No-shows may result in full charges for the session
• We reserve the right to cancel sessions due to trainer illness, facility issues, or insufficient bookings
• Refunds for cancelled sessions will be processed according to our refund policy

Payment Terms

Payment for services must be made in accordance with the payment terms agreed upon at the time of booking or membership registration. We accept various payment methods as displayed on our website. All prices are inclusive of applicable VAT. Late payments may result in suspension of services and additional charges.

Intellectual Property

All content on our website and in our training materials, including text, graphics, logos, images, audio clips, digital downloads, and software, is the property of BrightLibrarium or our content suppliers and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which forms part of these terms. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Limitation of Liability

To the maximum extent permitted by law, BrightLibrarium shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our services, including but not limited to personal injury, property damage, or loss of profits. Our total liability to you for any claim arising from these terms or your use of our services shall not exceed the amount you have paid us for the specific service giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless BrightLibrarium, its directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of our services, violation of these terms, or infringement of any third-party rights.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands. If you are a consumer resident in the European Union, you may also have the right to bring proceedings in the courts of your country of residence.

Dispute Resolution

We encourage the resolution of disputes through direct communication. If you have any concerns or complaints about our services, please contact us first to allow us the opportunity to resolve the matter. If a dispute cannot be resolved through direct communication, it may be subject to mediation or arbitration as provided by Dutch law.

Termination

You may terminate your use of our services at any time by providing written notice. Termination does not relieve you of any obligations incurred prior to termination.

Force Majeure

BrightLibrarium shall not be liable for any failure or delay in performance under these terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, or government regulations.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any modifications constitutes acceptance of the revised terms. We encourage you to review these terms periodically.

Severability

If any provision of these terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent.

Entire Agreement
